Confidentiality Agreement

  • 1. This Agreement is a public contract—by using the orakul.com service (hereinafter, the “Service”) of Arviti Consultants Limited, postal address: 17 Gr. Xenopoulou, 3106 Limassol, Cyprus, e-mail: lawyer.blyz@gmail.com (hereinafter, the “Owner”), the User fully adheres to this Agreement and confirms acceptance of the terms set out below.
  • 2. While using the Service, the User grants the Owner the right to collect and process the User’s data, namely:
    • 2.1. information the User provides when completing the Service’s registration forms and while using the Service;
    • 2.2. cookie;
    • 2.3. P addresses;
    • 2.4. Internet-browser parameters and settings.
  • 3. The Owner adds the User’s data to the personal-data database of Internet users from the moment the User first starts using the Service and for as long as the User continues doing so. The data-retention period equals the duration of the User’s use of the Service plus the three following years.
  • 4. The Owner collects and processes the User’s personal data by any lawful means to provide the Service properly (sending subscription-based informational materials, clarifying the User’s requests, responding to enquiries and correspondence, and performing other actions that may be required from time to time).
  • The User may withdraw consent to the collection and processing of personal data by unsubscribing.

  • 5. The Owner also collects and processes anonymised User data for marketing purposes, including: targeted advertising or other informational materials by age, gender or other criteria; compiling user lists; creating personal profiles; conducting statistical research; and displaying any advertising or informational materials, including personalised ones. Such collection and processing observe the principle of pseudonymisation so that the User cannot be directly or indirectly identified. The User agrees that the Owner may transfer any anonymised, non-identifying data to third parties (e.g., advertising systems such as Google Adsense). The User may withdraw consent to the collection and processing (including storage) of anonymised data by:— adjusting cookie, parameter and browser-setting controls—see the relevant instructions for:
    Microsoft Internet Explorer, Google Chrome, Safari, Firefox, Opera;
  • 6. The Owner may transfer personal data, or the entire personal-data database containing the User’s personal data, in whole or in part, to third parties without notifying the User in the following cases: to persons who assume administration, possession or ownership of the Service; to persons affiliated with the Owner; and to any new owner and/or operator of the Service for the purposes set out in this Agreement.
  • 7. While the User is browsing the Service, third-party Internet resources may embed code on Service webpages, enabling those third parties to obtain the data specified in clauses 2.1–2.3 independently; the Owner does not itself transmit the User data it processes to such third parties. By agreeing to this Agreement, the User consents to those third parties receiving the data specified in clauses 2.1–2.3 and to their right to store and process that data for marketing purposes—including targeted advertising and informational materials by age, gender or other criteria; compiling user lists; creating personal profiles; statistical research; and displaying any advertising or informational materials, including personalised ones. Such third-party resources include:
    • 7.1. traffic-analytics systems (e.g., Google Analytics counters, etc.);
    • 7.2. social-network plug-ins (e.g., Facebook widgets, etc.);
    • 7.3. banner-advertising systems (e.g., Google AdWords, AdRiver, etc.);
    • 7.4. other resources.
  • 8. Personal-data processing takes place in data centres housing the equipment that operates the Service. The Owner implements all legally required measures to protect personal data, including processing on equipment located in secured premises with restricted access.
  • 9. If the Owner breaches this Agreement, the User may lodge a complaint with the competent supervisory, law-enforcement or judicial authorities.
